1. Introduction

This Privacy Policy describes how DARE Legal Technologies Inc. d/b/a Hourglass (“Hourglass,” “we,” “our,” or “us”) collects, uses, and discloses information about you when you interact with our website at onhourglass.com (the “Site”). This Privacy Policy also explains your rights and choices with respect to such information.

By accessing or using the Site, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please discontinue use of the Site.

Scope and Customer Data

Hourglass provides automated timekeeping and billing compliance software to law firms and legal professionals. When we process information on behalf of our customers through our platform (the “Service”), that processing is governed exclusively by the agreements we maintain with each customer, not by this Privacy Policy. This Privacy Policy applies only to information collected through the Site.

Our customers are responsible for their own privacy practices with respect to the data they submit to or collect through the Service. If you are an end user of the Service and have questions about how your information is handled, please contact the organization that provides you access to Hourglass. If you wish to submit a request directly to us regarding data processed on behalf of a customer, please identify the relevant customer so we can coordinate a response.

2. Information We Collect

We collect information in two ways: information you provide to us voluntarily, and information we gather automatically when you visit the Site.

A. Information You Provide

You may provide information to us in a number of contexts, including:

  • Contact and Inquiry Information. When you request a demonstration, submit a form, subscribe to communications, or otherwise reach out to us, we may collect your name, email address, phone number, company name, job title, and the content of your message.
  • Event and Marketing Information. If you attend a webinar, conference, or other event we host or sponsor, we may collect registration details and related information.
  • Employment Application Information. If you apply for a position with Hourglass, we may collect information you submit in connection with your candidacy, including your resume, cover letter, references, and work history.
  • Survey and Feedback Information. If you choose to participate in a survey or provide feedback, we may collect the responses and any other information you elect to share.

B. Information Collected Automatically

When you visit the Site, certain information is collected automatically through the use of cookies, log files, and similar technologies:

  • Device and Browser Information. This includes your Internet Protocol (IP) address, browser type and version, operating system, device identifiers, language preferences, and Internet service provider.
  • Usage Information. This includes the pages you view, the links you follow, the date and time of your visit, the duration of your session, referring and exit URLs, and similar navigational data.
  • Location Information. We may derive your approximate geographic location from your IP address.

C. Information from Other Sources

We may receive information about you from publicly available sources, industry partners, co-marketing partners, and other third parties. We treat such information in accordance with this Privacy Policy and any additional restrictions imposed by the source.

3. Cookies and Tracking Technologies

We use cookies and similar technologies on the Site to facilitate functionality, analyze usage patterns, and support our marketing efforts.

  • Cookies are small data files placed on your browser that help us recognize returning visitors, remember preferences, and understand how the Site is used.

  • Business Partners. We may share information with partners with whom we jointly offer content, events, or services.
  • Corporate Affiliates. We may share information with entities under common ownership or control with Hourglass.
  • Corporate Transactions. In the event of a merger, acquisition, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will provide notice of any such transfer and any choices you may have regarding your information.
  • Legal Requirements. We may disclose information when we believe in good faith that disclosure is necessary to comply with applicable law, regulation, legal process, or governmental request; to enforce our agreements; or to protect the rights, safety, or property of Hourglass, our users, or the public.
  • With Your Consent. We may share your information for purposes disclosed to you at the time of collection or otherwise with your express permission.

6. Your Rights and Choices

A. Marketing Communications

You may opt out of promotional emails by using the unsubscribe link in any marketing email or by contacting us directly. Please note that even after opting out, you may still receive transactional or administrative communications related to your interactions with us.

B. Cookies

Most browsers allow you to manage cookie preferences, including blocking or deleting cookies. Consult your browser’s help documentation for instructions. Please be aware that restricting cookies may impair certain features of the Site.

C. Do Not Track

Some browsers transmit “Do Not Track” signals to websites. There is currently no universally accepted standard for how to respond to these signals, and we do not currently respond to them.

7. Jurisdiction-Specific Rights

A. California Residents

If you are a California resident, the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), may afford you additional rights regarding your personal information. These rights may include the right to know what personal information we collect, use, and disclose; the right to request deletion of your personal information; and the right to opt out of the sale or sharing of personal information. Hourglass does not sell personal information as defined under the CCPA.

B. European Data Subjects

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you may have rights under the General Data Protection Regulation (“GDPR”) or equivalent local legislation. These rights may include the right to access, correct, delete, or port your personal data, as well as the right to restrict or object to certain processing activities.

Our legal bases for processing your personal data include: performance of a contract, compliance with legal obligations, our legitimate business interests (such as improving the Site, preventing fraud, and direct marketing), and, where applicable, your consent.

Where we transfer personal data outside of the EEA, UK, or Switzerland, we implement appropriate safeguards, including standard contractual clauses approved by the European Commission.

You have the right to lodge a complaint with your local data protection authority if you believe your rights have been infringed.

C. Nevada Residents

Under Nevada law, you may submit a request directing us not to sell certain personal information we have collected or may collect about you. To submit such a request, please contact us using the information provided below.

8. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect the information we collect through the Site from unauthorized access, use, alteration, and destruction. No method of transmission over the Internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security.

9. International Data Transfers

Hourglass is based in the United States, and the information we collect through the Site is processed and stored in the United States. If you access the Site from outside the United States, please be aware that your information may be transferred to, stored in, and processed in a jurisdiction whose data protection laws may differ from those of your country of residence. By using the Site, you consent to this transfer. Where required by applicable law, we will provide appropriate safeguards for cross-border transfers.

10. Children’s Privacy

The Site is not directed to individuals under the age of sixteen (16), and we do not knowingly collect personal information from children. If we become aware that we have inadvertently collected personal information from a child, we will take steps to delete such information promptly. If you believe a child has provided us with personal information, please contact us.

The Site may contain links to websites, platforms, or services operated by third parties. We are not responsible for the privacy practices or content of those third-party properties. We encourage you to review the privacy policies of any third-party site you visit.

12. Changes to This Privacy Policy

We may revise this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make material changes, we will update the “Effective Date” at the top of this page and, where appropriate, provide additional notice. Your continued use of the Site following the posting of a revised Privacy Policy constitutes your acceptance of the changes.
